Common sense prevailed unfortunately! I wonder what you could be charged with. Not stealing, if you used your own loco. Trespass isn't a criminal offence. The town police take very little notice if we complain about rogue motorcycles or 4x4s. If they are also riding on the railway property and we complain to the Transport Police, they take it very seriously. As I understand it railway bylaw legislation dates from the original railways established by acts of parliament - and there is no distinction between Network Rail and any other railway operator. It's possibly also worth noting that the The British Transport Police website http://www.btp.police.uk/ states "British Transport Police is the national police force for the railways providing a policing service to rail operators ..." which would suggest they include operators like the F&WHR in their remit. So, I would doubt they apply to SMR or F&WHRs although you might have the bizarre situation where it might apply between Caernarfon and Dinas. I have often thought it surprising that the FR is not fenced along the Cob! Still |
